Florida's Abortion Laws and Regulations

Here’s a closer look at the key laws currently in effect.

Understanding Florida's Abortion Ban and Regulations

As of May 2024, Florida has enacted a 6 week abortion ban, as well as mandated certain requirements and regulations prior to receiving an abortion.

Ultrasound Requirement

Before any abortion procedure, Florida law mandates that an ultrasound is performed. Why is this important? The ultrasound helps accurately determine the gestational age of the pregnancy, which is a critical factor in understanding your medical options.

As part of this regulation, you’ll be offered the chance to view the ultrasound image and have it explained to you by a medical professional. This step ensures that you’re fully informed before making any decision.

Multiple Doctor’s Visits Are Required

Florida requires a minimum of two in-person visits to a medical provider before an abortion can be performed. The first visit involves counseling, where you’ll receive all the necessary medical information about the procedure and alternatives.

The second visit is when the procedure itself may be performed, but only if all legal requirements have been met, including waiting periods and signed consent forms.

Mandatory 24-Hour Waiting Period

Florida law enforces a mandatory waiting period of at least 24 hours between the initial consultation and the abortion procedure. This waiting period is designed to provide additional time for reflection and to ensure that your decision is well thought out and made without outside pressure.

Mail-Order Abortion Pills Are Illegal

Unlike in some other states, mail-order abortion pills are illegal in Florida. Abortion medication must be administered under the supervision of a licensed physician following all state guidelines. This regulation is in place to ensure that abortions are conducted safely and appropriately.

If you’ve been considering ordering abortion pills online, it’s critical to understand that doing so would violate state law. Additionally, unsupervised abortion methods can pose serious health risks.

Abortion Complications? Help Is Always Available

One of the most common misconceptions is that seeking follow-up care after an abortion is prohibited. This is not true. If you’ve experienced complications or need medical care after an abortion, you have every right to seek treatment without fear of legal consequences.
